Welcome to Sujiva Atlas. By accessing or using our healthcare CRM and cloud report storage services, you agree to be bound by these Terms of Service. Please read them carefully.

1. Acceptance of Terms

By creating an account or using Sujiva Atlas services, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to these terms, you may not use our services.

2. Service Description

Sujiva Atlas provides:

  • Cloud-based healthcare CRM system
  • Secure storage for patient medical reports
  • Report interpretation assistant via Windows CRM application
  • Patient portal for report access and download
  • Analytics and reporting tools for healthcare professionals

3. Eligibility

To use Sujiva Atlas, you must:

  • Be a licensed healthcare professional or authorized healthcare facility
  • Be at least 18 years of age
  • Have the legal authority to enter into this agreement
  • Comply with all applicable healthcare regulations (HIPAA, HITECH, etc.)

4. Account Registration

You agree to:

  • Provide accurate, current, and complete information during registration
  • Maintain and update your account information
  • Keep your password secure and confidential
  • Notify us immediately of any unauthorized access
  • Accept responsibility for all activities under your account

5. HIPAA Compliance

As a healthcare service provider, you acknowledge that:

  • Sujiva Atlas acts as a Business Associate under HIPAA
  • A Business Associate Agreement (BAA) is required for PHI processing
  • You are responsible for obtaining patient consent for data storage
  • You must comply with all HIPAA Privacy and Security Rules
  • You will report any suspected breaches immediately

6. Acceptable Use

You agree NOT to:

  • Use the service for any unlawful purpose
  • Upload malicious code, viruses, or harmful content
  • Attempt to gain unauthorized access to our systems
  • Interfere with or disrupt the service
  • Share your account credentials with unauthorized persons
  • Use the service to store non-medical or personal data
  • Reverse engineer or copy our software
  • Violate any applicable laws or regulations

7. Data Ownership and Rights

You retain all ownership rights to your data. Sujiva Atlas:

  • Does not claim ownership of your patient data or reports
  • Will not access your data except for service provision or legal requirements
  • Provides you with tools to export your data at any time
  • May use anonymized, aggregated data for service improvement

8. Payment Terms

For paid services:

  • Fees are billed in advance on a subscription basis
  • All fees are non-refundable except as required by law
  • You authorize automatic billing to your payment method
  • Prices may change with 30 days notice
  • Failure to pay may result in service suspension

9. Service Availability

We strive for 99.9% uptime but cannot guarantee uninterrupted service. We are not liable for:

  • Scheduled maintenance downtime
  • Service interruptions due to circumstances beyond our control
  • Third-party service failures
  • Internet connectivity issues

10. Data Backup and Recovery

While we maintain regular backups:

  • You are responsible for maintaining your own backup copies
  • We do not guarantee data recovery in all circumstances
  • Backup retention periods are specified in your service plan

11. Termination

Either party may terminate this agreement:

  • You may cancel your account at any time through your account settings
  • We may suspend or terminate your account for Terms violations
  • Upon termination, you have 30 days to export your data
  • We will delete your data after the retention period unless legally required to retain it

12. Limitation of Liability

To the maximum extent permitted by law:

  • Sujiva Atlas is provided "as is" without warranties of any kind
  • We are not liable for indirect, incidental, or consequential damages
  • Our total liability is limited to the amount you paid in the last 12 months
  • We are not responsible for medical decisions made using our service

13. Indemnification

You agree to indemnify and hold Sujiva Atlas harmless from any claims, damages, or expenses arising from:

  • Your use of the service
  • Your violation of these Terms
  • Your violation of any laws or regulations
  • Your violation of third-party rights

14. Intellectual Property

All intellectual property rights in the Sujiva Atlas platform, including software, design, and content, belong to us. You may not:

  • Copy, modify, or distribute our software
  • Use our trademarks without permission
  • Remove copyright or proprietary notices

15. Modifications to Terms

We may modify these Terms at any time. We will notify you of significant changes via email or through the service. Continued use after changes constitutes acceptance of the modified Terms.

16. Governing Law
